SUCI is registered in Malaysia and this website is operated by SUCI SOLUTIONS ENTERPRISE (SUCI). Throughout the site, the terms “we”, “us” and “our” refer to SUCI. This website, including all information, tools and services available from this site is offered by SUCI to you, the user, with the condition of your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you are engaging in our “Service” and agree to be bound by the following terms and conditions “Terms”, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

This is a condensed version of our Terms and Conditions which displays a summary of terms. You acknowledge that you have read the expanded version of the Terms and Conditions provided in the links and agree that it is binding to this agreement. 

Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. Shipping and delivery 

SUCI processes orders for shipping from Monday to Friday, excluding public holidays. Orders received on weekends and holidays will be processed the next business day. 

Orders received between 0000 - 2359, will be sent on the next working day. 

Saturday & Sunday - Off

SUCI will contact you via email if there are any issues with your order. A submitted order is considered an agreement to the general terms of sale and any other conditions listed on this site, including the privacy policy and the return & exchange policy. SUCI reserves the right to cancel a purchase at any time. In the case of a cancellation, you will be notified by e-mail of the cancellation and the reason for cancellation within three (3) business day of purchase.

 

4. Terms of Service

4.1 Online Store Terms

By agreeing to these Terms, you agree that you are of the age of majority, at least, in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our Products for any unauthorized or illegal purpose. You may not violate any laws in your jurisdiction (including, but not limited to, copyright laws) when using our Service.

4.2 Accuracy of Information 

We reserve the right to refuse any order you place with us according to conditions stated in the Terms of Service. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

Your submission of personal information through the store is governed by our Privacy Policy.

5. Terms Of Purchase 

5.1 Products Or Services

We have made every effort to describe and display our Products as accurately as possible, including the colours and images we use, in our online shop. We are not responsible for the differences in colour, texture or size portrayed when using different screens or monitor

5.2 Changes To Service And Prices

Prices for our Products are subject to change without notice.

We reserve the right at any time to change or stop the Service (or any part or content thereof) without notice at any time.

If, for any reason, a mistake in pricing is made, we have the right to refuse to accept the order made.

5.3 Exchanges And Refunds

Suci Cup is a personal hygiene care product. It cannot be exchanged, replaced or refunded once payment has been made (Suci Cup holds a NO EXCHANGE, NO REFUND policy except on a case-to-case basis which requires a written request from you, and is subject to review and consent from SUCI, at SUCIs sole discretion). Once sold, the Suci Cup cannot be returned. 

Most women can successfully use the Suci Cup on their first try. However, some may require several days or even several menstrual cycles before being able to use it correctly and comfortably. You will be able to get support from a link to our online user manual (found on the packaging), FAQ website, our customer care support team as well as our closed community Facebook group (Suci Circle) for authentic sharing. 

We have made every effort to provide information and support to new users. We are not liable for any problems or difficulties arising from your use of the cup.

5.4 Promotional Campaigns And Discounts

You acknowledge that it is NOT possible to use several promotions at once or in conjunction with each other unless otherwise specified in the particular promotion. The promotional code that was applied before checkout will be the one applied to the order.

You agree that it is your responsibility to confirm which offer you are entitled to and to review your order prior to checkout. 

We will not be held liable for extra costs incurred due to any negligence on your part in reviewing a promotional code.

5.5 Liability 

5.5.1 Proper Use

You agree that you have read and equipped yourself with the necessary knowledge beforehand on how to properly use and care for the cup, including:

1. 1. To properly sterilize the Suci Cup in boiling water for at least 3 minutes once a month (before menstruation and/or after menstruation).
   2. To learn the best positions and methods of insertion and removal, including to relax the pelvic muscles, wash the hands, ensure proper lubrication and proper folding (for insertion) and seal-breaking (for removal) techniques. 
   3. To remove and empty the Suci Cup every 4-10 hours and reinsert if need be.  

We shall not be liable for any injuries or damages you incur from the incorrect/improper use or cleaning/maintenance of the Suci Cup. 

5.5.2 Use In Conjunction With Underlying Female Reproductive Conditions

We recommend that women who have underlying female reproductive conditions including, but not limited to, the following, to consult a doctor or healthcare provider before use of the Suci Cup:

1. 1. Vaginismus
   2. Uterine fibroids
   3. Endometriosis
   4. Variations in uterine position

Though there is no literature to support that the use of the Suci Cup in combination with these conditions causes harm, there may be some discomfort on a case to case basis. Your doctor or provider will be able to discuss the individual benefits and risks of the use of menstrual cups with your condition. 

You agree that you are responsible for confirming whether you are fit to use the Suci Cup before using the Product.

We shall not be liable for any injuries or damages incurred from any negligence on your part to consult a provider beforehand.

5.5.3 Potential Risks

Menstrual cups are generally regarded as safe by the medical community. However, as with all menstrual hygiene products, there is a measure of potential risk, though they are minimal:

• • INFECTION - This is a rare complication when hygiene measures are observed. However,  it is more likely to be from bacteria on your hands transferred to the cup than from the cup itself. Infections include, but are not limited to, yeast infections and bacterial vaginosis. This can be prevented by washing your hands thoroughly with water and soap before using the Suci Cup. You should only wash your cup with a mild, fragrance-free, water-based soap before and after use. We cannot be held responsible and do not offer any kind of compensation in any cases of infection.

• • PAIN AND INJURIES - Inserting any object into the vagina may cause pain or small injuries. You are more likely to experience these issues if you insert the Suci Cup in a rough manner, have long nails, or are using an incorrect size. This could be due to differences in anatomy or that the Suci Cup is in an incorrect position. We cannot be held responsible and do not offer any kind of compensation in any such cases.

• • INTRAUTERINE DEVICE (IUD) - The Suci Cup can be used with IUDs, but we strongly recommend consulting your doctor and/or gynaecologist prior to use. As long as the Suci Cup is inserted and removed properly (by breaking the seal before pulling it out), it is safe to use in conjunction with the IUD. We cannot be held responsible for any kind of IUD errors or failings, or the consequences of such a failing, including it being dislodged, and we do not offer any kind of compensation in such cases.

• • TOXIC SHOCK SYNDROME (TSS) - TSS is a rare, but severe condition, that has been linked to, but not limited to, usage of tampons in women. It is a complex infection and is infrequently seen with the use of menstrual cups. However, in order to minimize this risk, we recommend the following: 

• • Sterilize your SuciCup before using it at the beginning of every period (see Proper Use).

• • Remove the Suci Cup every 4-10 hours during your period, empty and wash thoroughly before reinserting.

• • Do not use the Suci Cup or any internal vaginal devices if you have previously been diagnosed with TSS.

• • Wash your hands every time you handle the Suci Cup

• • We cannot be held liable for any cases of TSS linked to the use of the Suci Cup.

• • ALLERGIC REACTIONS - You agree that you are responsible to check if you have an existing allergy or sensitivity to silicone before using the cup. There is minimal risk of developing allergies, sensitivities or irritations due to usage. However, if you do develop an allergic reaction, we cannot be held responsible and do not offer any kind of compensation in such cases.

5.5.4 Medical Attention

Although potential risks are highly unlikely, it is possible. See and talk to a doctor or other healthcare provider if you begin experiencing:

1. 1. Unusual vaginal discharge
   2. Vaginal pain or soreness
   3. Burning during urination or intercourse
   4. Foul odour from the vagina
   5. Inability to remove after 10 hours

You should seek immediate medical attention if you experience:

1. 1. A high fever
   2. Dizziness
   3. Vomiting
   4. Rash (may resemble sunburn)

5.5.5 Force Majeure

We cannot be held responsible for an unseen event of force majeure and as such are not contractually bound to fulfil any obligations.

 

6. Support From Suci 

The information provided on our website is intended to ONLY be product-related guidance. Our support staff can ask for information from you to guide you with regards to product-use ONLY. Any advice that can be construed as medical coming from our staff, unless stated explicitly is from a Doctor, will not be treated as such. 

If you have medical-related questions or concerns, we strongly recommend that you consult a doctor or gynaecologist for more information. Any guidance by our support staff cannot be construed as medical advice. 

We cannot be held responsible for any advice given by third parties on forums or social media, including our Facebook Group (Suci Circle) about the Suci Cup. You agree to verify this information yourself. We will not give compensation for any cases related to this. 

 

7. Indemnification

You agree to indemnify, defend and hold harmless SUCI and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third-party.

 

8. Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

 

9. Disputes

You agree that disputes on matters regarding the purchase and use of Suci Cup Products should first be dealt with directly with the company. This can be done via email to [email protected]. Otherwise, disputes can be resolved through arbitration.

 

10. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws governing B-3A-12, Suria Jelutong, Jalan Bazar U8/99, Bukit Jelutong, 40150 Selangor Darul Ehsan, Malaysia.
